Local Law 152: Missed Inspection and Penalty

Determine whether the building missed its gas-piping inspection or filing, address safety first, and resolve the resulting DOB record.

Local Law 152 generally requires covered buildings outside the R-3 and one- or two-family exclusions to inspect gas piping every four years. In 2026, Cycle 2 Sub-cycle C covers Community Districts 4, 6, 8, 9, and 16. A missed certification can trigger a $5,000 civil penalty. Confirm the current requirement in the cited agency system and in any notice issued for the property.

Decide whether the property is covered before scheduling

The requirement applies to gas piping systems in most buildings except one- and two-family homes and other buildings classified in Occupancy Group R-3. DOB also lists Department of Finance building classifications that do not need to comply.

A covered building with no gas piping still needs a certification signed and sealed by a registered design professional or Licensed Master Plumber. A covered building with gas piping but no current gas service follows a separate owner-and-utility statement path.

  • Confirm whether the building is covered, its community district, subcycle, gas service status, and prior filing.
  • Check DOB NOW for the inspection or certification record and any civil penalty or violation.
  • Engage a Licensed Master Plumber and separate late-compliance work from any immediately unsafe finding.

Complete the inspection and certification sequence

Hire an active Licensed Master Plumber or qualified person working for one. Unsafe or hazardous conditions require immediate notification and correction. Beginning July 27, 2026, DOB directs Local Law 152 certifications and transactions to DOB NOW: Safety.

  1. Arrange the required inspection or no-gas-piping certification through the permitted professional path.
  2. Respond immediately to unsafe conditions and complete required utility or emergency notifications.
  3. Submit the required certification and supporting information through DOB’s current portal.
  4. Address the civil penalty or eligible challenge and verify the property’s final compliance record.

Use the community-district cycle and 30/60/120/180-day sequence

The property-specific deadline comes from its Community District. DOB currently publishes the following Cycle 2 schedule and post-inspection filing sequence.

A July 2026 DOB service notice lists $35 fees for an inspection certification, extension request, and correction certification; $375 for a no-gas-piping certification; and $480 for no-gas-service documentation. Confirm the fee shown in DOB NOW before submission.

Local Law 152 mistakes to avoid

Use this list as a final review before filing, paying, certifying, or closing the internal task.

  • Assuming that no active gas account means no filing is required.
  • Using borough instead of Community District to determine the cycle.
  • Hiring without checking the LMP’s active license and disciplinary history.
  • Receiving the LMP report but failing to submit the owner certification within 60 days.

Retain the property classification, Community District, coverage decision, LMP credentials, report, certifications, correction work, utility statements, portal receipts, extension, and penalty status.

Confirm DOB received the certification

A completed late inspection does not by itself erase a civil penalty, and payment does not replace the filing. Confirm both compliance and financial records.

The plumber’s inspection report is not the owner’s filing. Preserve the DOB portal confirmation and any later correction certification.
